Republican Texas Representative Chip Roy has put forth a resolution on Friday aimed at ousting President Joe Biden from office in the wake of Thursday night’s presidential debate. Roy’s resolution under the 25th amendment seeks to prompt Biden’s cabinet members to formally assert that the president is unable to carry out his official responsibilities. Biden’s performance in the debate against former President Donald Trump has been widely criticized as a significant failure, even by Democratic insiders and media outlets that have typically supported Biden’s presidency and campaign.
The 25th amendment’s fourth section, which Roy is citing, grants the vice president and a majority of cabinet officials the authority to declare the president unfit to serve and replace Biden with Vice President Kamala Harris, as outlined by the National Constitution Center.
The resolution calls on Harris “to immediately use her powers under section 4 of the 25th Amendment to convene and mobilize principal officers of the executive departments in the Cabinet to declare that President Joseph R. Biden is unable to discharge the duties and powers of the office” and to inform the pro tempore president of the Senate and Speaker of the House Mike Johnson “that she will be immediately assuming the powers and duties of the office as Acting President.”
